Sales & Service Terms

Terms for Creative, Hardware & Digital Solutions

1. Introduction and Acceptance

These Product Purchase Terms & Terms of Service (“Terms”) govern purchases of goods and hardware, commissioned creative work, and access to and use of the website at www.24-7media.com.au and the software, digital media and related services supplied by 24-7media Pty Limited (ABN 95 126 845 814) (“24-7media”, “we”, “us” or “our”).

By accessing our website or using our services, you agree to these Terms. If you are acting on behalf of an organisation, you represent that you are authorised to act for it. If you do not agree, please do not use the relevant services.

Specific quotations, orders, licences or written service agreements may contain additional terms. If there is an inconsistency, the specifically agreed written terms prevail to the extent of the inconsistency.

2. Our Products and Services

24-7media offers digital video and animated content, LED and digital signage content, promotional software and interactive solutions, display management platforms, and related hardware and creative services. Availability and features depend on the product or service ordered.

Descriptions on our website are general information, not a guarantee that any particular feature, integration, hardware configuration or result will be available for every customer.

3. Product Descriptions and Compatibility

We aim to describe our products, hardware, accessories and software accurately. Images, demonstrations and specifications may be illustrative, and minor variations may occur. The specifications and inclusions confirmed in your accepted order govern your purchase.

Before ordering, please check power, mounting, dimensions, connectivity, operating environment, software and third-party equipment compatibility. If a product requires installation, configuration or licensing, the applicable quotation will state whether those services are included.

4. Stock, Lead Times and Delivery

Stock availability and dispatch or delivery dates may vary, particularly for specialised, imported or made-to-order hardware. Any estimated lead time is an estimate rather than a guaranteed delivery date unless expressly agreed otherwise.

Delivery charges, destination and method will be confirmed in the applicable order. Please provide accurate delivery details and notify us promptly of any damage, missing items or incorrect goods, so we can investigate. This request does not limit your rights under Australian law.

Risk and ownership in physical goods pass at the time specified in the applicable written sales agreement, subject to applicable law. Where no such arrangement has been agreed, the parties' rights are determined by applicable law.

5. Returns, Refunds and Faulty Goods

If a product is faulty, damaged, not as described or otherwise fails to meet an applicable consumer guarantee, contact us with your order details and a description of the issue. We will assess the circumstances and provide remedies required by Australian law.

Change-of-mind returns are not automatically available. Any voluntary change-of-mind return, restocking fee or special-order cancellation arrangement must be confirmed in writing before it applies and cannot override statutory rights.

Do not send items back without first contacting us for return instructions. Where return costs must be borne by us under applicable law, we will meet those obligations.

6. Custom Products, Creative Work and Installation

Customised hardware, branded products, video content, graphics, software development and other bespoke work are supplied to the agreed specifications and scope. Customers must review and approve proofs, specifications, artwork, milestones and deliverables when requested.

Changes requested after approval may require a revised quote, schedule or additional fees. Deposits, cancellation costs, acceptance criteria, installation requirements and ownership of commissioned deliverables are governed by the accepted quotation or written agreement, subject to non-excludable legal rights.

Unless expressly included, installation, site preparation, electrical work, network connectivity, mounting hardware, permits, venue approvals and ongoing support are not assumed to form part of a product purchase.

7. Manufacturer Warranties and Support

Some physical products may carry manufacturer warranties, and some products may have separate setup or support arrangements. Any applicable voluntary warranty period, claim process and exclusions will be provided with the product or order documentation.

We may help coordinate warranty assessments or manufacturer support where appropriate. Manufacturer warranty conditions do not reduce consumer rights that apply under Australian law.

8. Accounts and Authorised Users

Where an account is required, you must provide accurate information, keep login credentials confidential and ensure access is limited to authorised users. You are responsible for activity carried out through your accounts except to the extent caused by our breach of law or contract.

Notify us promptly if you suspect unauthorised access or misuse. We may require reasonable identity or authority checks before changing account access.

9. Acceptable Use

You must use our website, software and services lawfully and in accordance with applicable instructions. You must not:

  • Upload or publish unlawful, misleading, defamatory or infringing material.
  • Attempt unauthorised access to systems, accounts or data.
  • Introduce malicious code, disrupt operations or bypass security controls.
  • Reverse engineer or redistribute software except where permitted by law or an express licence.
  • Use the services to infringe another person's privacy, intellectual property or other rights.

We may investigate credible misuse and take proportionate action, including restricting access where reasonably necessary to protect systems or other users.

10. Customer Content and CSV Imports

Our platforms may allow you to enter information manually, import CSV files and publish content such as food and beverage menus, jackpot history displays, promotions, event times and schedules.

You retain rights you hold in your content. You grant 24-7media a non-exclusive licence to host, copy, process, transform and display that content solely as reasonably necessary to provide, secure and support the services and as otherwise authorised in your agreement.

You are responsible for the accuracy, legality, permissions and appropriate use of material and personal information you submit, including imported datasets, images, trademarks, pricing, prize information and event details. Review imported information and preview displays before publication.

11. Display Content and Regulatory Compliance

Customers are responsible for reviewing their displayed information and meeting laws, licences, advertising standards and venue requirements applicable to their activities, including any rules relevant to gaming promotions, jackpots, prize offers, pricing and consumer information.

24-7media supplies technology and creative services; unless separately agreed in writing, we do not provide legal, regulatory or gaming compliance approval for customer content.

12. Orders, Quotes, Pricing and Payment

Product purchases and service engagements may be arranged through a quotation, purchase order, invoice, website or direct communication. An order is subject to acceptance by 24-7media. We may contact you to confirm specifications, stock, delivery details or payment before accepting an order.

Prices, currency, inclusions, freight, installation, taxes and payment milestones will be set out in the applicable quote, order confirmation or invoice. Unless expressly stated otherwise, prices are in Australian dollars and GST is included or added as required by law, as specified in the relevant offer.

We will advise you of material pricing or availability errors before accepting an affected order. Payment is due in accordance with the agreed terms. We may withhold dispatch or commencement of work until an agreed deposit or payment is received, subject to applicable law.

13. Subscriptions, Renewals and Cancellation

Software subscriptions and managed services may have recurring fees. The term, billing frequency, renewal arrangements, notice requirements and cancellation process will be disclosed at sign-up or in the relevant written agreement. These Terms do not independently impose an automatic renewal.

Cancellation of a service or custom project may affect work already performed and third-party costs committed, as disclosed in the applicable agreement. Nothing in these Terms limits statutory cancellation, refund or consumer guarantee rights.

14. Software Licence and Intellectual Property

Unless expressly agreed otherwise, 24-7media and its licensors retain ownership of our software, website, original designs, systems, documentation, branding and other intellectual property.

Subject to payment and compliance with the applicable agreement, we grant the customer a limited, non-exclusive, non-transferable right to use the contracted software and services for its internal business purposes during the agreed term. No source code, trademark rights or ownership transfers unless expressly stated in writing.

Ownership and permitted use of commissioned creative deliverables are governed by the relevant quote or written agreement.

15. Third-Party Products and Links

Our services may use third-party hosting, payment, video, analytics or hardware providers and may link to external websites. Those services may have separate terms and privacy policies. We do not control independently operated websites or services.

Any third-party dependencies, licences or warranties identified in your order or service agreement also apply where relevant.

16. Availability, Maintenance and Changes

We aim to provide reliable services but may carry out maintenance, updates and security work. Temporary interruptions can occur due to networks, hosting providers, power, hardware, software or circumstances outside our reasonable control.

We may modify features where reasonably necessary for security, compatibility or service improvement. Material changes to contracted services will be managed in accordance with the applicable agreement and law.

17. Security and Backups

We take reasonable steps to protect our systems. You should maintain secure credentials, restrict user permissions and retain appropriate copies of business-critical source files and data.

Backup, recovery, export and deletion commitments, if any, are determined by the relevant service agreement. Do not assume that published displays or imported files constitute your sole backup.

18. Privacy and Personal Information

Our handling of personal information is described in our Privacy Policy. Customers who upload personal information must have an appropriate legal basis and provide any required notices or obtain any necessary consents.

Where we process personal information on a customer's behalf, the respective responsibilities of the parties may be further described in a written agreement.

19. Suspension and Termination

We may suspend or restrict access where reasonably necessary to respond to a security incident, serious misuse, legal requirement or material breach of these Terms, taking account of urgency and any contractual notice requirements.

Either party may terminate services as permitted by the relevant agreement or applicable law. Following termination, access, outstanding payments, content export and retention are governed by that agreement, our Privacy Policy and legal obligations.

20. Australian Consumer Law and Product Guarantees

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law where that law applies. Depending on the circumstances, you may be entitled to a repair, replacement, refund, cancellation or compensation for reasonably foreseeable loss.

For a major failure with goods, an eligible consumer may choose a refund or replacement and may be entitled to compensation. For a failure that is not major, we may be entitled to provide a remedy within a reasonable time. Rights for services also depend on the nature of the failure.

Manufacturer warranties and any voluntary warranty offered by 24-7media are in addition to, and do not replace, your statutory rights. Please contact us with proof of purchase and details of the issue so we can assess an appropriate remedy.

21. Disclaimers and Liability

To the extent permitted by law, information on our public website is provided for general information and may change without notice. We do not guarantee uninterrupted or error-free access to websites or online platforms.

Any contractual limits or exclusions of liability are subject to mandatory legal rights, including the Australian Consumer Law, and any specific agreement between the parties. Nothing here excludes liability that cannot legally be excluded.

22. Feedback and Complaints

If you experience an issue with our services, please contact us with details of the relevant product, account or order and the issue encountered. We will review concerns and work towards a reasonable resolution in accordance with our obligations.

Privacy complaints are handled under our Privacy Policy.

23. Changes to These Terms

We may update these Terms from time to time. The current version and its effective date will appear on this page. Changes to existing paid services will take effect in accordance with any notice, acceptance and variation requirements in the applicable agreement and law.

24. Governing Law

These Terms are governed by the laws of New South Wales, Australia, subject to any mandatory laws that apply. The parties submit to the courts of New South Wales and courts competent to hear appeals, without limiting any non-excludable rights.
